(PNA) -- Malvinne Alcala mastered Bianca Carlos in a duel of fancied bets,
fashioning out a 21-10, 21-9 romp to roll into the semifinal round of the Open
Ladies' singles in the MVP Sports Foundation-Bingo Bonanza Philippine Badminton
Ranking System (PBaRS) tournament at the Pohang Badminton Courts in Bacolod
City Friday.
Alcala showed the
form that won her the Li-ning Australia Juniors crown recently and outplayed
Carlos throughout, dethroning the defending champion in 25 minutes while
putting her on track of the crown in the premier division she missed while
competing in Australia last March.
The 16-year-old
national team mainstay �- and the country�s leading player today -� will
face Danica Bolos for a berth in the finals after the latter stopped

Communist leaders fall in Philippines: army

MANILA, April 20,
2011 (AFP) -
Two top communist
rebel leaders in the Philippines surrendered while a third was captured
Wednesday in a fresh blow to the insurgency amid ongoing peace talks, the army
said.
Marvin Capones and
his wife, Gelita, gave themselves up to the army on the central island of Samar
claiming they were tired of fighting, the military said in a statement.
Capones was the
vice commander of the New People's Army's (NPA) regional command in Samar,
while his wife was the medical officer.
"He directed
the operational command and was in charge of the armed component,"
regional army spokesman, Lieutenant Colonel Noel Vestuir told AFP.
"Their
surrender is a big blow to the revolutionary movement."
Meanwhile, an
intelligence officer of the NPA's rebel front on Negros island in a nearby area
of the central Philippines was also arrested.
Diro Sanchez was
wanted for various crimes, including extortion, the army said in a statement
without giving other details.
The NPA is the
armed unit of the Communist Party of the Philippines, which has been waging a
Maoist rebellion since 1969.
From a peak of
over 25,000 fighters in the 1980s, the military and other defence experts
believe it currently has less than 5,000 guerrillas.
The government
resumed peace talks with the rebels in February after a seven-year lull and
both sides said after the first round of negotiations they believed a peace
pact could be signed by June, 2012.
Chief government
negotiator Alex Padilla told AFP Wednesday he believed the latest surrenders
indicated divisions among the rebels' ranks, and would bolster his team's
position in the talks.
"It should
give renewed confidence on the government side," Padilla said.
He said the next
round of formal negotiations hosted by Norway would likely be in June.
The military often
claims victories whenever it arrests NPA leaders, but analysts say the
guerrillas remain a deadly force.
NPA attacks last
year killed 187 soldiers, police and pro-government militiamen, as well as
dozens of civilians caught in crossfire, the Brussels-based International
Crisis Group said in a February report.

Two years ago, the
United States Supreme Court held that plaintiffs claiming age discrimination
under the Age Discrimination in Employment Act ("ADEA") must show by
a preponderance of the evidence that age was the "but for" cause of the
adverse employment action. Gross v. FBL Fin. Servs., Inc., 129 S. Ct. 2343
(2009). The Supreme Court held: "The burden of persuasion does not shift
to the employer to show that it would have taken the action regardless of age,
even when a plaintiff has produced some evidence that age was one motivating
factor in that decision." Id.at 2352. The Supreme Court, however, declined
to answer whether the use of the familiar burden-shifting scheme of McDonnell
Douglas Corp. v. Green was still appropriate in the context of ADEA claims.
After the Gross
decision, some circuits continued to apply the evidentiary framework
articulated inMcDonnell-Douglas. Gorzynski v. Jetblue Airways Corp., 596 F.3d
93, 106 (2nd Cir. 2010); Geiger v. Tower Auto., 579 F.3d 614, 622 (6th Cir.
2009); Smith v. City of Allentown, 589 F.3d 684, 691 (3rd. Cir. 2009). While
the Eighth Circuit had opportunities to address the issue in these last two
years, it chose to punt the issue for a later time. See, e.g., Clark v.
Matthews Int'l Corp., 628 F.3d 462 (8th 2010) (declining to apply the
McDonnell-Douglas framework because the plaintiff did not argue for the
application of the burden-shifting analysis in the district court.)
Two years after
the Supreme Court's decision inGross, the Eighth Circuit has finally ruled on
this issue in Haigh v. Gelita USA, Inc., ___ F.3d. ___, 2011 WL 260303 (8th
Cir. Jan. 28, 2011). In Haigh, the Court affirmed the district court's granting
of summary judgment in favor of the employer. The Court held that, "In
order to prove his claim, [plaintiff] must show, by a preponderance of the
evidence, that age was the 'but-for' cause of the challenged adverse employment
action." The Court was then forced to take a stance on the effect of the
Grossdecision and held that ADEA plaintiffs' claims must be analyzed under the
familiar burden-shifting scheme ofMcDonnell-Douglas.
Under this burden
shifting scheme, an employee is required to show that (1) he is at least 40
years old; (2) he was terminated; (3) he was meeting his employer's reasonable
expectations at the time he was terminated; and (4) he was replaced by an
individual who was substantially younger. Id. If an employee establishes this
prima facie case of age discrimination, the burden shifts to the employer to
provide a legitimate, nondiscriminatory reason for the termination. If the
employer provides such a reason, the burden returns to the employee to prove
that the employer's reason was mere pretext for discrimination. In Haigh v.
Gelita, the Eighth Circuit affirmed the district court's granting of summary
judgment to the employer because the employer provided a legitimate
non-discriminatory reason for its discharge of the employee because the
employee had refused to work with his new manager.
This case in
important for Employment Law attorneys practicing within the Eighth Circuit.
Employment lawyers have been in limbo since the Supreme Court's decision in
Gross and were unsure whether the burden-shifting framework ofMcDonnell-Douglas
still applied in ADEA cases in the Eighth Circuit. Now that the Eighth Circuit
has made a definitive ruling on this issue, there is more certainty as to how
the law will be applied in age discrimination cases under the ADEA.

phosphating is a known method. Prior to passivation, there are usually
performed various cleaning steps when a surface treatment is to be performed on
casting molds or workpieces. According to the invention, it is proposed that
the passivating agent comprising an aqueous phosphate solution with metal ions,
is additionally provided with a gelatin. Further proposed are surface treatment
agents and spray-type surface treatment agents which comprise such a
passivating agent as well as non-ionic surface-active agents, lactic acid and a
citric acid monohydrate, and optionally a thickening agent. Thereby, preceding
cleaning steps can be avoided. Further, there is proposed a corresponding
method wherein these surface treatment agents are used. The proposed agents and
methods reduce the energy consumption and, in comparison with known agents,
allow for a better effect with regard to adhesive strength, promotion of
adhesion and thermal shock resistance."
